What is DACA?

DACA, or Deferred Action for Childhood Arrivals, is a program that allows undocumented immigrant children to seek temporary protection from deportation and have the ability to work in the US. The program has existed since 2012 and has helped over 834,000 youth and young adults grow and thrive in the US. DACA recipients are also known as DREAMERs.

The program is not currently a pathway to citizenship and has faced numerous legal challenges, despite broad popular support.

Who?

Who qualifies for DACA?

DACA holders are people who were under the age of 31 on June 15, 2012, entered the US when they were 15 years old or younger, and have been in the US continuously since June 15, 2007. Those who qualify for DACA must either be in school, have a GED/high school diploma, or be an honorably discharged veteran.

People who already have DACA may continue to renew their DACA as long as it is not expired more than one year.

Currently, no new applications for DACA are being processed due to a 2022 court order. First-time initial applicants who meet the above criteria may still apply, but their application and fee will be held without a decision until further notice.

How?

How does someone renew DACA?

US Citizenship and Immigration Services (USCIS) will continue to process DACA renewals for those who already have DACA, as long as their DACA is not expired long than one year.

DACA holders whose DACA and work permit expire within one year can apply for renewal early. USCIS encourages DACA holders to renew within 120-150 days of expiration, however renewals may be submitted early. Assistance from an attorney or accredited representative is recommended.
