On June 5, 2014, U.S. Citizenship and Immigration Services (USCIS) released its official guidance for renewing Deferred Action for Childhood Arrivals (DACA). That guidance can be accessed on the uscis.gov website.

Frequently Asked Questions

Below are some Frequently Asked Questions and Answers about how to submit your renewal application if you were granted DACA in the past. Note: this FAQ contains general information and is not legal advice.

Q: Who may be considered for RENEWAL of DACA?
A: An individual may be considered for renewal of DACA if he or she met the guidelines for initial DACA, AND he or she:

  1. Did not depart the United States on or after August 15, 2012 without advance parole;
  2. Has continuously resided in the U.S. since submitting the initial DACA application; and
  3. Has not been convicted of a felony, a significant misdemeanor, or three or more misdemeanors, and does not otherwise pose a threat to national security or public safety.

 

Q: When should I apply to renew DACA?
A: It is recommended that you file your renewal application at least 120 days (or 4 months) prior to your DACA expiration date (this expiration date is listed on your employment authorization card).  Note: if you try to file your application more than 150 days (or 5 months) before your expiration date, USCIS may reject it.

 

Q: Can I renew DACA even if I am now older than 30?
A:  Yes.  Eligibility for DACA renewal is not limited to people who are currently age 30 or under.  You cannot “age out” of eligibility for DACA as long as you were born after June 15, 1981.

 

Q: If I met the educational requirement for DACA when I applied the first time, do I have to submit anything new?
A: No.  Neither the DACA application form nor the instructions ask renewal applicants for information or documentation regarding school enrollment or graduation.
